The 4th World Conference on International Arbitration saw discussions delving into sports arbitration, arbitration in GCC and Arab states, recent global trends and arbitration amid the pandemic, on its second day on Wednesday.
The conference kicked off on Tuesday, under the patronage of Prime Minister and Minister of Interior HE Sheikh Khalid bin Khalifa bin Abdulaziz Al Thani.
Held under the theme ‘Impact of Arbitration on Achieving a Suitable Environment for Investment’, the two-day conference was organised by the Qatar International Centre for Conciliation and Arbitration (QICCA) at Qatar Chamber (QC) and coincided with the fifth anniversary of issuing the Qatari arbitration law and the issuance of QICCA’s new rules for conciliation and arbitration
Sports arbitration
The first panel on the second day focussed on arbitration in the field of sports. The panel was moderated by Khalid Al-Mohannadi, lawyer and international arbitrator, while speakers included Salman Al-Ansari, Partner at Al-Ansari and Associates Law Firm, who reviewed arbitral procedures of the Qatar Sports Arbitration Foundation (QSAF) and Professor. Abdulla Al-Hayan, Dean of Law School at Kuwait University, who discussed appeal proceedings against awards of the Court of Arbitration for Sport (CAS) before the Swiss Federal Court.
On her part, Khadeja Al-Zarraa, Senior Associate at Al-Ansari & Associates Law Firm, spoke about procedures of appealing the awards of the Qatar Sports Arbitration Authority, while Essa Al-Sulaiti, Chairman of Essa Alsulaiti Law Firm, examined ad-hoc arbitration according to CAS rules and procedures.
Arbitration in GCC and Arab states
Titled ‘Highlights on arbitration in GCC and Arab countries’, the second panel was moderated by Dr Sheikh Thani bin Ali Al-Thani, lawyer, international arbitrator and QICCA Board Member for International Relations.
Speaking at the panel Dr. Ismail Saleem, Director of Cairo Regional Centre for International Commercial Arbitration, highlighted arbitration in Egypt and arbitration rules of the Centre, while Professor Riyad Fakhri, Professor at University of Hassan II & Legal Counsel to the Minster of Health, highlighted the Qatari Mediation Law.
Dr. Moosa Al-Azri, CEO of the Oman Commercial Arbitration Centre, discussed arbitration in the Sultanate of Oman and rules of the Centre.
On his part, Dr. Tareq Al Shumaimry, General Secretary of GCC Commercial Arbitration Center, reviewed arbitration in the GCC region and overview of rules of the GCC Commercial Arbitration Centre.
Recent international trends
The third session was held under the theme ‘Recent international trends in the settlement of commercial disputes’ and was moderated by Mubarak Al-Sualiti, Chairman of Al Sulaiti Law Firm.
Professor Mohamed Sameh Amr, Former Chairman of Executive Council of UNISCO and Chair of International Law Dept. at Cairo University, discussed the recent developments in arbitration procedures and the Egyptian Court of Cassation principles and views in this respect.
For his part, Professor Georges Affaki, Professor of law at the University of Paris II and Co-founder of Affaki Law Firm-Paris, reviewed recent changes and development in international arbitration - principles and procedures, while Dr Imad Qaymansani, Assistant Professor College of Law at Qatar University, presented an overview of the Qatar Mediation Law and the confidentiality principles in the Law.
Dr Mohamed Salem Abu Al-Faraj, Associate Professor College of Law at Qatar University, spoke about third-party arbitration funding in terms of concept and practical obstacles, while Professor Riyad Fakhri, Professor at University of Hassan II & Legal Counsel to The Minster of Health, highlighted mediation rules in the Maghreb region.
Arbitration amid the
pandemic
Moderated by Marwan Al Musleh, former General Counsel at Ras Gas Group, the fourth panel discussed exceptional procedures for international commercial arbitration amid the Covid-19 pandemic.
Speaking at the session, Professor Loukas Misteils, Professor of Transnational Commercial Law and Director of the QMUL-UNIDROIT Institute of Transnational Commercial Law at Queen Mary Law School, focussed on principles, proceedings, and obstacles to virtual arbitration hearings.
On his part, Gold Smith, UK former Attorney General and Chair of European and Asian Litigation at Debevoise & Plimpton, highlighted the impact of Covid-19 on principles and procedures of arbitration, while Dr. Zachary Calo, Professor of law at the College of Law at Hamad Bin Khalifa University, discussed the relation between technology and ADR.
George Vlavianos, FCIArb and Partner of DLA Piper, reviewed a practical case for arbitration in the face of COVID-19.
Recent changes in the rules of arbitration institutions
The third panel of on day one highlighted the recent amendments of the arbitration rules of many arbitration institutions.
The panel was moderated by Faisal Al-Sahouti, Chief Executive Officer at Qatar International Court and Dispute Resolution Centre.
During the session, Professor Georges Affaki, Professor of law at the University of Paris II & International arbitrator and lawyer, reviewed the most important amendments on the ICC arbitration rules for 2022.
For her part, Fatma Khalifa, Associate Legal Officer at UNCITRAL Secretariat, spoke about the UNCITRAL expedited arbitration rules and ISDS Reforms, while Christopher Coello, Legal Counsel of The Arbitration Institute of the Stockholm Chamber of Commerce (SCC), elaborated on the principles and recent amendments in the SCC Rules.
Dr Muna Al-Marzouqi, Dean of Law School at Qatar University, discussed rules of QICCA in comparison with rules of the Qatar Financial Centre.
Arbitration proceedings
Deputy- Chairman of Qatar Engineers Association, Eng Mohamed Al-Kuwari moderated the fourth panel on day 1, which focussed on arbitrator and arbitration proceedings.
Speaking at the panel, James Bridgeman, former Presider of CIArb, reviewed rules of CIArb on impartiality and independency of the arbitrator, while Professor Ahmed Sayyed Mahmoud, Professor of Procedural and Arbitration Law at Qatar University, discussed rules for Emergency arbitration between UNCITRAL and QICCA rules.
On his part, Dr Nader Ebrahim, Professor of Commercial and Maritime Laws at Qatar University, touched on the role of party autonomy with institutional arbitration rules.
